New allegations on 1MDB scandal: More clarity still needed

Story behind the story: Wright and his ‘Billion Dollar Whale’ co-author Hope have published new allegations on 1MDB but the anonymity of their sources could compromise their credibility.

Nothing should be assumed too easily about even an established scandal like 1MDB, certainly not guilt or culpability, if sound investigations and public confidence are not to be prejudiced.


JUST when everyone seemed inured to shocking details about 1MDB, Wall Street Journal (WSJ) reporters appeared to have come up with more.

Investigative reporters Tom Wright and Bradley Hope, who covered 1MDB issues before, made additional claims last Monday that would be shocking if proven true.

They say that upon the initiative of Malaysian authorities, China offered to bail out 1MDB’s debts or losses in exchange for Malaysia’s support for China’s Belt and Road Initiative (BRI) projects.

These projects were further said to have come at inflated costs, were acknowledged as unprofitable, and lacked transparency in their implications.

Wright and Hope say their information came from the minutes of “secret meetings” between Malaysian and Chinese officials and the personal testimony of some Malaysian officials past and present.

The authors could have been more transparent about their sources and on the content of their revelations, but apparently not.

Countries do sometimes engage in such intrigue, but nonetheless it is always easier to allege than to verify. Serious allegations such as these require equally serious substantiation.

The gist of the claims had been troubling thoughtful Malaysians, yet few expected it to take such form. Not without reason, doubts linger about the details and accuracy of these claims among all parties.

Even when current government officials could have made political capital by weighing in, making the former government’s alleged actions seem nastier, they refrained from it.

Formal meetings between government officials of two countries are routinely confidential and therefore “secret”, so there is nothing particularly sinister about their unreported nature.

There is also doubt about the minutes of meetings containing compromising information. Some meetings were said to be in China where Malaysian officials visited, yet the hosts freely permitted the visitors to go home with the recorded minutes of potentially explosive discussions.

The WSJ’s story has present and former Malaysian officials informing it about a supposedly secretive pact between Malaysia and China, yet senior Malaysian officials both past and present know nothing about it. Both sets of Malaysian officials are genuinely concerned and seriously want to know. Yet it is said that some Malaysian officials already knew, had known for more than half a year since last May, and who preferred to tell all to the WSJ only now rather than to their colleagues or the media earlier.

The media at the time also did not know, neither Malaysiakini, Sarawak Report, nor any other that was actively covering the issues, despite a freer news environment after last May’s election that encouraged whistleblowing and exposés.

For the kinds of sources said to have been used for the WSJ story – minutes of several meetings, and the testimonies of officials – the substantiation has been rather lean.

In its January 7 report of just 1,703 words, only two dates (June 28 and September 22, 2016) have been mentioned for the meetings. Two Chinese officials had been named at the meetings but not any Malaysian.

Xiao Yaqing, Chairman of the State-owned Assets Supervision and Administration Commission, is quoted as stressing the importance of one particular meeting but nothing else.

Sun Lijun, “head of China’s domestic security force,” is cited as mentioning his agency’s capacity in conducting surveillance on parties inimical to Malaysia’s previous government, but nothing about what Malaysia is supposed to do in return.

Each of the two named persons had only part of a story to tell, with nothing to substantiate the larger claims made by the WSJ’s reporters. There is nothing definitive like a “smoking gun” to back those claims.

No Malaysian official at any of the meetings has been named or quoted, not even in reported speech. For many observers that seems odd, particularly where deals were supposedly agreed between two sides.

Malaysia is also supposed to have agreed to BRI projects only when China offered to bail out 1MDB. That presumption seems somewhat stilted.

Later in the story, former Prime Minister Datuk Seri Najib Tun Razak is said in reported speech to have voiced support for “China’s position in the South China Sea during a regional summit in Laos.”

Najib’s Government may have been quiet on China’s sweeping maritime territorial claims, it was certainly less vocal than Vietnam or the Philippines on the dispute, but nowhere can it be said that it supported China’s position in the South China Sea.

And an Asean summit would have been the last place such a thing could have happened, even if it ever did. The WSJ story also claims that China had offered Malaysia its influence in stopping US investigations into 1MDB and Malaysian leaders at the time.

Given the highly competitive China-US relationship, particularly in third countries, what possible “influence” could China really have on the US in stopping investigations into allegedly shady deals involving China?

For many observers, the US would have had every incentive to proceed with such investigations, the more so when China appeared to be apprehensive about them.

It would be utterly foolish for any Chinese official to think there is such influence, and totally naïve for any Malaysian official to believe it. The same seems to apply to readers of the WSJ story.

The story behind the story is that the documents such as the minutes of meetings had been discovered in official files left behind by the previous Government after it had vacated official premises following its election defeat.

Again, many would doubt that the ousted officials had taken all possibly incriminating material with them as they left, except for these highly revealing documents.

The new Pakatan Harapan leaders had also been slow in taking office, first with the delayed swearing-in ceremony of the new Prime Minister and then in the phased nature of ministerial appointments.

Yet despite these delays, it is said that the departing Barisan Nasional leaders still did not retrieve the documents that could be used against them.

The WSJ sources rest on the what (documented minutes) and even more on the who (Malaysian officials who provided the minutes, and those who testified to it).

All of these officials are persons unknown or unnamed. Anonymity sometimes accords legitimate protection, but not now when it only compromises their credibility.

When serious allegations are levelled against one party or another, in this case against both Chinese and former Malaysian officials, some vested political interests of someone somewhere could be served.

It has also been implied that other “secret talks” had led to Malaysia’s readiness for Chinese naval vessels to dock in Malaysian ports.

But to a non-aligned country, the docking of vessels from friendly nations for supplies and refuelling should not be an issue – certainly not an issue requiring the seal of approval from secret negotiations.

Sarawak Report, which initially gave 1MDB information to several newspapers including WSJ, has since complained about some of its methods.

The WSJ has done very good work on 1MDB investigations and similar stories before, and it will most certainly do so again.

Najib and Jho Low have meanwhile rejected the latest WSJ story as expected, but others also have their doubts.

To get to the truth behind hazy intrigues, both clarity and credibility are essential at every stage. That has yet to happen consistently with 1MDB coverage.

1MDB scandalous Bombardier Global 500 Jet parking fees of RM3.5mil to be paid if govt wants it back

PETALING JAYA: Malaysia will have to cough up at least RM3.5mil to bring the Global 5000 private jet that belongs to fugitive Low Taek Jho, better known as Jho Low, back to Malaysia.

The luxury private jet, which was impounded by the Singapore authorities since February last year, is currently parked at the Singapore Seletar airport.

“However, before the plane is allowed to be flown to Malaysia, Seletar airport has asked for settlement of the parking charges first,” said a source.

The source said the parking charges over the last 18 months have escalated to about RM3mil.

It is learnt that Seletar airport had indicated the fee to the Singapore authorities following Malaysia’s keen interest in taking possession of the plane.

Seletar airport is managed by Changi Airport Group Pte Ltd, a facility mainly used for private flights.

Changi Airport Group declined to comment on the parking charges.

“Due to client privacy, we will not be able to share the information,” its spokesman told The Star.

The source said the Malaysian government would have to pay the fee before the airport authority allows the plane to leave its tarmac.

It is understood that negotiations on the parking charges have been held between the Malaysia and Singapore authorities and the airport operator.

But to date, the source said, they have yet to reach a conclusion on the payment.

“The Malaysian government would also have to fork out another RM500,000 to service the aircraft, which has been grounded and left under the sun at the airport apron,” said the source.

The source said the aircraft that has been grounded since February last year is currently undergoing service maintenance work to ensure its airworthiness before it is allowed to be flown to Malaysia.

“The maintenance work on the airport craft is almost completed,” said the source.

The plane is likely to be taken to Subang Airport, a facility mainly used by private planes, said the source.

The Global 5000 jet was listed by the US Department of Justice (DoJ) as one of the assets bought using Malaysia’s state-owned 1MDB laundered money, through a series of shell companies and bank accounts.

In a court filing in June 2017, the US DoJ document stated Jho Low used part of the US$700mil (RM2.3bil in 2009) diverted from the 1MDB to acquire the luxury jet.

The Bombardier Global 5000 built in 2008 costs about US$35.4mil (RM145mil). The aircraft was bought at the end of 2009, less than three months after the US$700mil was moved away from 1MDB.

The plane, registered in the US as N689WM/MSN 9265, is registered to a company called Wynton Aviation and placed as a trust with Wells Fargo Bank Northwest.

Wynton Aviation is a company that was registered in the British Virgin Isles in 2009. The DoJ stated that Wells Fargo’s records indicate that it is a holding company owned by Low.

It was learned that prior to the plane being seized, the jet was based at Teterboro Airport New Jersey, close to Jho Low’s New York home.

Airliners.net website showed the plane had flown to Paris, Geneva, Beijing and London among other countries between 2009 and 2017.

Prime Minister Tun Dr Mahathir Mohamad had on Aug 13 said Malaysia was keen to take possession of the aircraft.

Early in the month, Malaysia also took possession of the superyacht Equanimity from the Indonesian authorities.

The vessel, valued at US$250mil (RM1bil), was handed over to Malaysian authorities near Indonesia’s Batam island on Aug 6.

It has since been brought back to the Boustead Cruise Centre in Pulau Indah.

Equanimity, which according to DoJ belongs to Jho Low and purchased with funds diverted from 1MDB, was seized by the Indonesian authorities in Tanjung Benoa port, Bali, in February.

The yacht, which is 54th in luxury vessels of its class in the world, was seized at the request of US authorities as part of its initiative to recover the billions diverted from 1MDB.

Another source said due to the high maintenance of the superyacht and its crew, the Indonesian government had decided to turn over the vessel to Malaysia at the request of Dr Mahathir when he visited Jakarta in June.

Najib arrested, charged and pleaded not guilty

Former premier Najib Abdul Razak was arrested at his residence in Jalan Duta, Kuala Lumpur, this afternoon, according to MACC chief commissioner Mohd Shukri Abdull.

The arrest was carried out in relation to the commission's investigation into the SRC International issue.

Speculation is also rife that the former premier could be charged tomorrow.

Shukri Abdul told the media that the arrest took place at 3pm and the former premier has been taken to the commission's headquarters in Putrajaya for further questioning.

Previously, MACC had recorded Najib's statement twice with regard to the SRC International issue.

Last Friday, Malaysiakini had reported that there is a strong likelihood the former premier would be arrested this week.

Jobs ahead for Pakatan's first 100 days fiscal reform


Dr Mahathir moves swiftly to inject confidence and stability into the market

WHEN the results of the 14th general election were finally formalised early Thursday morning, showing that Pakatan Harapan had won and would form the new government, there was a sense of excitement among its voters over the reforms promised by the incoming administration.

At the same time, that wave of buoyancy was tinged with worries of uncertainty. Malaysia was taking a path not traversed and for financial markets, anxiety is something they have never digested well.

Prime Minister Tun Dr Mahathir Mohamad since then has moved swiftly to inject confidence and stability among investors and the population.

His swearing in as PM and the announcement of key ministries in the Cabinet will help in soothing nervy investors ahead of Monday when the stock market opens.

The early movements of the stock market will be closely watched and that is something Dr Mahathir too has quickly sought to assuage. He tried calming anxious investors by saying he expects the stock market to see its capitalisation increase over time. He also assured businesses and investors that Malaysia remains business-friendly and the economy is among his top priorities.

Hints of what businesses and investors can expect are laid out in Pakatan’s manifesto and its to-do list within the first 100 days. Central among the pledges is the confirmation that the unpopular goods and services tax (GST) will be cancelled and replaced with a sales and services tax (SST).

The other measures it intends to carry out in the initial period is to reduce the cost of living, stabilise the price of petrol and introduce targeted petrol subsidies, abolish unnecessary debts that have been imposed on Felda settlers, introduce EPF contributions for housewives, equalise the minimum wage nationally and start the processes to increase the minimum wage, postpone the repayment of the National Higher Education Fund Corp or PTPTN for all graduates whose salaries are below RM4,000 per month and abolish the blacklisting policy.

It also plans to set up a Royal Commissions of Inquiry into 1Malaysia Development Bhd, Felda, Mara and Tabung Haji and reform the governance of these bodies. A Special cabinet committee to properly enforce the Malaysia Agreement 1963 will be set up. There are plans to introduce the Skim Peduli Sihat with RM500 worth of funding for the B40 (low-income) group for basic treatment in registered private clinics, and initiate a comprehensive review of all mega-projects that have been awarded to foreign countries.

What impact the measures will have on government finances is another source of uncertainty but Socio-Economic Research Centre executive director Lee Heng Guie feels it’s too early to assess any impact. “We will have to wait and see if Pakatan will table a new budget. The current estimates are based on the old budget, but I believe the Pakatan budget will continue with fiscal consolidation,” he says.

AmBank Group Research chief economist Anthony Dass says there needs to be some clarification on the new government’s policy and strategy without risking the ratings.

“Removing the GST and introducing the SST and other subsidies will act positively on the economy, as they help to improve the disposable income of households, and thus, spending. This will help buffer any shortfalls from the GST. Besides prudent financial management as we have seen in Selangor and Penang, a more transparent public procurement system or tendering process will improve competition and lower margins for players and ease budget strains,” he says.

Fiscal implications

Among the to-do list for its first 100 days in office, it is the promise to repeal the GST that has rating agencies worried.

“We are closely following the developments around some campaign promises that could have a negative impact on market sentiment and trigger volatility in the financial markets. These dynamics will take time to unfold and a lot will depend on what the new Government unveils in the coming weeks and months,” says Moody’s Investors Service Financial Institutions Group vice-president Simon Chen in a statement.

“If investor sentiment worsens materially, we will see increasing risks of capital outflows and a further weakening of the ringgit, that could in turn dampen private-sector consumption and operating conditions for banks in Malaysia.”

He did, however, say that Malaysia has weathered challenging periods, in particular, during the 1MDB scandal.

Fitch Ratings in a statement says the May 9 results means a higher likelihood of fiscal and economic policy change.

 “The extent to which the new government’s agenda will shift major policy is uncertain, but the Pakatan victory and its policy platform indicate a much greater potential for change. In the meantime, Fitch will monitor the new Government’s policy agenda as it evolves,” it says.

It views policy slippage leading to deterioration in fiscal discipline and higher government debt or deficits as a negative rating sensitivity.

“Among the most notable proposals is the replacement of the GST – a value-added tax launched in 2015 – with the narrower SST that had preceded it. The GST has become a key source of government revenue, accounting for 18% of total revenue equivalent to just over 3% of gross domestic product (GDP) in 2017.

“By comparison, the SST accounted for only 8% of total revenue and 1.6% of the GDP in its last year, 2014. As such, absent offsetting measures, the replacement of the GST would result in a correspondingly higher deficit,” it says.

Fitch points to another significant proposal, which is to reinstate some of the fuel subsidies. It says that if fuel subsidies were to be reinstated, they could offset some potential budgetary gains from rising oil and commodity prices.

Maybank Investment Bank in a report says that the removal of the GST will mean a projected revenue loss of RM44bil based on the current budget estimates. It says that even if the GST is replaced by the SST, which brought in RM17bil in 2014, there could be a prospective loss of RM27bil in government revenue and that could lift the budget deficit by 1.9 percentage points.

The report, however, does point to Pakatan’s alternative budget released in October 2017, which says that abolishing the GST will stimulate the economy and raise other tax revenues by boosting consumer and business activities. It says tax revenues will rise from better economic growth, higher receipts of corporate income tax, real property gains tax and other sources of income.

Government expenditure is also expected to drop by cutting certain allocations such as for the Prime Minister’s Office that can help buffer the cost of the GST removal.

It says that operating expenditure could be improved by having open tenders and the rationalisation in non-critical spending from supplies and services, which accounts for 14.4% of operating expenditure, grants and transfers to state governments and statutory bodies (9%) and the others’ category (7.8%), which consists of grants to statutory funds, public corporations and international organisations as well as insurance claims and gratuities.

Higher oil prices, however, are a revenue source for the Pakatan government and can help mitigate the loss of income from the removal of the GST. Maybank’s analysis shows that for every US$10 rise in the crude oil price, government revenue will rise by between RM7bil and RM8bil. That increase will have to be balanced out by the Pakatan manifesto’s pledge to give higher royalties to Sabah and Sarawak, and petrol subsidies.

Growth direction

Fiscal consolidation will mean there will likely be an impact on economic growth, as government expenditure plays an important role in generating growth. Economists are, however, optimistic that consumption boost from lower prices from the removal of the GST will help buffer any shortfall from spending.

They feel that the policies that will be rolled out in the coming months will be positive for the market and economy.

“We reiterate our -2.8% budget deficit to GDP for 2018 with the GDP to grow around 5.5%, supported by domestic demand and exports on the back of a stronger global GDP,” says Dass.

“We foresee better management in the operating expenditure with a more transparent procurement system or tendering process and efficiency in development expenditure projects and targets.”

Maybank is keeping its 2018 growth target at 5.3%, pending details on Pakatan’s economic policies.

“We are neutral to positive on the consumer spending growth outlook, based on Budget 2018 and Pakatan’s GE14 manifesto on measures to address living costs and boost disposable income. The main issue on the growth outlook now is investment, as businesses adopt a ‘wait-and-see’ stance and amid potential government reviews of several China-linked infrastructure projects and investments,” it says.

The investment climate, though, will be crucial in generating higher economic growth for the new government.

Lee says investor-friendly policies are important and the next three to six months will be important after Cabinet positions are filled and their work starts.

“Dr Mahathir’s strong track record, added with Datuk Seri Anwar Ibrahim as the prime minister-in-waiting and the maturity of Malaysians as reflected in this GE, augur well for the country. These are positive signs on the business and consumer confidence,” says Dass.

“This will help the investment mood to improve and the pick-up in capital expenditure.”

KUALA LUMPUR: The Government has vowed to end “crony capitalists” whose wealth came at the cost of ordinary Malaysians, said Datuk Seri Najib Tun Razak.

The Prime Minister said lessons had been learnt from past mistakes in planning Malaysia’s economic transformation, after confronting many “legacy issues” along the way.

“Some of the country’s development under a former leader came with an unnecessary price tag, in the form of a class of crony capitalists,” he said in his keynote address at Invest Malaysia 2018 yesterday.

Citing public transport as an example, Najib said massive overhauls had to be done to rectify the issue.

“For decades, public transport was neglected. It was incoherent, with different owners, different systems and certainly no integration

“One man’s obsession with the idea of a national car – which is now being turned around under international joint ownership – led to Malaysia lacking an efficient public transport system.

“This was a serious obstacle to achieve high-income status and for Kuala Lumpur to be a world-class capital,” he said.

Although no name was mentioned throughout his speech, it was an apparent dig at former premier Tun Dr Mahathir Mohamad.

Najib also said that during this time, the Government had signed independent power producer concessions that were lopsided.

“Consumers had to pay far more for energy than they should have, even for energy they were not using.

“This was a real burden to the people, so we renegotiated these concessions – and determined that in the future, we would not allow private companies to earn excessively at the expense of ordinary Malaysians,” he said.

Najib also pointed out that the ringgit had been pegged against the US dollar for “far too long”.

“Investors and global markets lost confidence in us, and it took a long time to win that back. That was a very heavy cost to the country,” he said, stressing that the Government would never repeat that measure.

He also spoke on the challenges at state-owned institutions, such as 1Malaysia Development Bhd (1MDB), which were amplified and used as a tool to suggest that Malaysia’s economy was collapsing.

“I’m not going to brush over this issue. There were indeed failings at the company, there were lapses of governance. There was a valid cause for concern.

“This is why I ordered one of the most comprehensive and detailed investigations in Malaysia’s corporate history, one that involved multiple lawful authorities, including a bipartisan parliamentary body.

“Their findings were taken on board and the company’s board was dissolved, its management team changed and its operations reviewed,” he said.

On another note, Najib rubbished claims that Malaysia was welcoming foreign direct investments (FDIs) by selling out the nation’s sovereignty.

“My Government will never sacrifice an inch of our sovereignty,” he said, adding that while RM63bil in FDI stock came from China and Hong Kong, there was more from Japan at RM70bil.

“You don’t hear anyone warning that we are selling our country to the Japanese.

“Of course not. They are most welcome here. So are investors from Africa, the Americas, China, the European Union, India, Saudi Arabia and around the world,” he said.

The Prime Minister observed that the country’s excellent economic and financial fundamentals had greatly benefitted local and foreign investors, providing them with stability, strength and certainty.

“We will continue to make our country even more business- and market-friendly, which means we are always working to improve transparency, accountability and efficiency.

“The Securities Commission, Bursa Malaysia, Bank Negara Malaysia and the Finance Ministry have continuously introduced and supported measures to increase the dynamism of our capital market.

“Towards this objective, I can assure you that we can expect further measures in the near future,” he said in his keynote address at Invest Malaysia 2018 here yesterday.

The two-day annual event is jointly organised by Bursa Malaysia Bhd and Maybank. A total of 61 local companies, with a combined market capitalisation of RM767.6bil were featured in the event.

The Prime Minister also cited figures that justified the confidence in Malaysia shown by investors and global institutions.

“Our total trade grew strongly by 20.8% between January and November last year, while in November alone, gross exports reached double-digit growth of 14.4%, with the highest receipts ever recorded, at RM83.5bil.

“Last year, foreign net fund inflow recorded a positive RM10.8bil, the highest since 2012, while corporate bond and new sukuk issuance reached RM111.2bil for 11 months of the year, close to 30% higher than the whole of 2016,” he said.

Najib also observed that Malaysia has enjoyed years of strong growth, with figures that most developed economies “could only dream of”, even during times of economic uncertainty.

“In fact, last year Malaysia exceeded all expectations, with the World Bank having to revise its estimate for our growth upwards not once, not twice, but three times – to 5.8%,” he said.

Najib added the World Economic Global Competitiveness index for 2017 and 2018 rate Malaysia very highly out of 137 countries.

The country is ranked third for Strength of Investor Protection, fifth for Pay and Productivity, fifth for the low Burden of Government Regulation and 14th for the Quality of Education System.

“The International Monetary Fund has also praised our sound macroeconomic policy responses in the face of significant headwinds and risks.

“The World Bank also recently confirmed that it believes Malaysia is on track, and that we are expected to achieve high-income status in the next few years,” he said.
